Religion is a binding system of rules in human life, becoming the main axis of the concept of a God-fearing human being. Islam is a perfect religion that formulates all aspects of human life, both worship and muamalah. In Islam, alcoholic beverages (khamar) are totally prohibited because they are considered an evil and satanic act, and bring more sin and harm than benefit. Islamic law focuses on the preservation of five things (al-maqasid al-khamsah), including religion, life, and reason. Ironically, in Indonesia, there is a normalization of the culture of drinking alcohol, including in Sampang, Madura, which is predominantly Muslim, often at traditional events such as wedding parties (le melle). In fact, alcohol has serious negative effects, such as physical and mental health problems, juvenile delinquency, fighting, and immoral acts. The local government, through local regulations, is trying to control the distribution of alcohol. However, from the perspective of Islamic Criminal Law, the legalization of alcohol is not in accordance with sharia and the concept of maslahah because it contradicts the objectives of sharia and causes more harm than good. Based on Law Number 6 of 2014 concerning Villages, villages hold an important position in the regional governance system and have the authority to manage their own community affairs. However, villages still face many challenges, such as poverty, low levels of education, and the potential for social conflict due to weak legal certainty. This study uses a qualitative approach with a case study method, involving in-depth interviews and observations of villagers who participated in the election. The results indicate that the village head election in Telaga Biru Village has had a negative impact on the importance of integrity in collective decision-making, as well as the community’s discipline in upholding democratic values and consultation (musyawarah). The concept of shura emphasizes the importance of accepting differences, being open to compromise, and recognizing the limitations in realizing idealism. This study aims to analyze how the Pilkades process unfolded and the extent to which the principles of shura were applied in forming joint decisions fairly, honestly, and free from manipulation. Sohibul Liwak sohibulliwak@gmail.com <p>Praktik pungutan liar (pungli) merupakan tindakan yang merugikan masyarakat dan bertentangan dengan prinsip keadilan dalam hukum Islam. Permasalahan yang diangkat dalam penelitian ini adalah bagaimana bentuk dan penjelasan hukum terkait pungli dalam perspektif Islam, serta bagaimana pandangan empat mazhab fiqih Hanafi, Maliki, Syafi’i, dan Hanbali terhadap praktik pungli. Para imam mazhab berbeda pendapat mengenai klasifikasi dan sanksi atas perbuatan pungli, namun secara umum sepakat bahwa pungli termasuk dalam perbuatan yang dilarang dan dapat dikenakan sanksi ta’zir oleh penguasa sebagai bentuk pencegahan dan penegakan keadilan. Penelitian ini menggunakan pendekatan kualitatif dengan metode komparatif dan konseptual. Metode komparatif digunakan untuk menganalisis perbedaan dan persamaan pandangan antara empat mazhab dalam menyikapi praktik pungli, sedangkan pendekatan konseptual dilakukan untuk memahami kedudukan pungli dalam konteks hukum Islam secara teoritis. Data diperoleh melalui studi literatur terhadap kitab-kitab fiqih klasik dan kontemporer yang membahas ta’zir serta kejahatan terhadap hak publik. Pungutan liar (pungli) merupakan tindakan ilegal, seperti halnya yang telah dilakukan oleh juru parkir liar yang sangat merugikan masyarakat dan bertentangan dengan prinsip keadilan dalam hukum positif maupun hukum Islam, yang dalam literatur fikih disebut <em>al-muksu</em>. Islam mengecam keras praktik ini karena merampas hak orang lain tanpa dasar yang sah, dan mengganggu tujuan syariat dalam melindungi harta dan keadilan sosial. Dalam pandangan empat mazhab Hanafi, Maliki, Syafi’i, dan Hanbali pungli dapat dikenakan hukuman <em>ta?z?r</em>, yakni sanksi fleksibel yang diserahkan pada kebijaksanaan hakim untuk pelanggaran di luar kategori hudud dan qishash. Despite the legal amendment of Law No. 16 of 2019 which raised the minimum marriageable age to 19 for both genders, the practice of <em data-path-to-node="4" data-index-in-node="319">nikah siri</em> remains a prevalent loophole used to bypass state regulations. This study aims to analyze whether such marriages can be legally categorized as a form of child sexual exploitation under the Indonesian criminal law framework. Using a normative-legal research method with a conceptual and statute approach, this study examines the synchronization between the Marriage Law, the Child Protection Law (Law No. 35 of 2014), and the Sexual Violence Crimes Law (Law No. 12 of 2022/UU TPKS). The results indicate that underage <em data-path-to-node="5" data-index-in-node="293">nikah siri</em> inherently contains elements of sexual exploitation, as child consent is legally considered invalid (<em data-path-to-node="5" data-index-in-node="405">void ab initio</em>) due to the power imbalance and lack of legal capacity. Furthermore, the study finds that the "religious justification" often used in these marriages serves as a facade for "modern slavery" or "forced marriage," where children are deprived of their reproductive rights and education. The analysis concludes that law enforcement must shift its perspective from seeing <em data-path-to-node="6" data-index-in-node="83">nikah siri</em> as a mere administrative or private matter to a serious criminal offense. By applying the <em data-path-to-node="6" data-index-in-node="184">ultimum remedium</em> principle, the state should prosecute both the adult perpetrators and the guardians who facilitate such unions.
